Prepare For The What Ifs In Life

Hi there. My name is Bridget Mackay. I’m an attorney in Petaluma, California. I do estate planning, wills, trusts, probate, trust administrations. Today I want to talk to you about: Now that you’ve planned you’re fabulous vacation, but have you planned for the “what ifs”? So, as we all venture out this summer, we have planned our vacations to the last detail ’cause you want to have a good time, right? But have you considered what can happen while you’re gone? Do you ever think: What if something happens to the house while you’re gone? Or if you were in an accident, what would happen to your kids? You don’t want to worry about these potential problems as you try to rest peacefully on that tropical beach in your oceanside getaway.

These thoughts have probably have entered your mind at one time or another. Even though the risks of dying while vacationing is low, planning will ease your fears and make your trip more enjoyable so you aren’t thinking about these things, and really enjoying the environment and your family. Basic planning, even at the last minute, can prevent you from waking up panicked in the middle of the night in your tropical paradise. And the basic plan includes four documents… Or a basic plan includes four documents. Some of which you could probably get done before you leave. Durable power of attorney is one, and that designates an agent for your financial assets, if you become incapacitated or go missing. An advanced healthcare directive is another document, and it designates a person to have a legal authority to make your medical decisions if you can’t on your own. It’s a good document to take with you when you’re traveling in case something does happen while you’re traveling.

The next is a will. And it has several functions, but most importantly, it’s to designate someone to be the physical guardian of your children. Otherwise, the court has the right to decide who will be a guardian of your children if something were to happen to you. And finally, a living trust. This avoids probate and it’ll hold legal title to your assets and distribute them as you designate in the document. Before you pack up your suitcase to get going on your vacation, take a look at this stuff and make it a more stress-free, enjoyable time.
